Dear users (hereinafter referred to as "users", "users", "you"), welcome to ShortMax! Before you log in,
access or use the ShortMax products and services (hereinafter referred to as "Service", "ShortMax") provided
by this platform and its affiliates (hereinafter referred to as "we", "us", "our"), please read the User
Terms of Service (hereinafter referred to as "Terms") carefully, particularly those sections that may limit
our liability or pertain to your significant rights. If you do not agree with our terms, you may not use the
Service. Your use and/or continued use of the Service signifies your acceptance of all terms of the Service.
You affirm to us that you are an adult and possess full legal capacity. If you are a minor or lack full legal capacity, you will not be permitted to register, log in, or use the Service. These Terms encompass the following terms and conditions, the agreements explicitly contained herein, and all rules that we may announce in the future. All these rules are considered an integral part of the Terms and have the same legal effect. Unless explicitly stated otherwise, your use of the Services signifies your agreement to be bound by these Terms, forming a legally binding contract between you and us.
We retain the right to modify and/or amend these Terms periodically by posting notices and/or through other reasonable means. You are encouraged to regularly check the revised Terms, which you must comply with when using the Services. Your continued use of our Services signifies your acceptance of the revised Terms. Any dispute between you and ShortMax shall be governed by the latest Terms. If you disagree with the revised Terms, you must cease using the Services.
To use the service, you must create an account approved by us and log in. If you access the service through a
third-party account approved by us, you must ensure the reliability, authenticity, and availability of the
account. If you are unable to log in to ShortMax due to a third-party account issue (such as the account
being suspended), please contact the company that owns the account. Your account number will be the sole
reference for us to verify your identity.
You should bind your account using your mobile phone number
(one mobile phone number can only register one account). Please register your account with a mobile phone
number that has not been linked to your ShortMax account and has not been suspended by us. The method of
account registration and binding may change according to user or product needs, and you agree to comply with
such changes that meet local laws and regulations. You agree that we will use the mobile phone number you
provide and/or the mobile phone number and mobile device identification code we automatically extract when
you register.
Since ShortMax is a location-based mobile entertainment product, you can decide whether to authorize us to disclose and use your location information when registering. If you grant us such permission, we will provide you with more personalized services based on your location. If you do not grant us such permission, you will still be able to use the basic functions and services we provide, though it may affect related services based on location information.
When you register, log in, or use ShortMax, we need to collect personal information from you that can identify you, so that we can contact you or provide you with a better User Experience when necessary. You agree to provide true, detailed, and accurate personal data ("Personal Data") with your consent. Personal Data may include, but is not limited to, username, gender, age, date of birth, ID, address, occupation and industry, height, weight, income, interests, personal data, and other information you register/update. You agree to promptly update any changes to your personal information. If the personal information you provide is inaccurate, false, or contains illegal/objectionable information, we may reject your registration application and terminate your use of the Service.
You agree not to:
(1) Use any false information to register your own ShortMax account;
(2) Without
relevant permission, register your own ShortMax account in the name of others;
(3) Register your ShortMax
account excessively;
(4) Register and maintain more than one ShortMax account during the same period.
If you use false information to fraudulently use a registered account, or your account profile photo, personal profile, and other information contain illegal/harmful content, we have the right to take measures such as notifying you to correct or suspend the use of your account within a specified period; we have the right to cancel an account registered in the name of another person or in bad faith and report it to the competent government department.
You acknowledge that: You are fully competent and legally capable of agreeing to these Terms of Service in
accordance with the laws and policies of each country, and you are able to independently bear responsibility
for your use of the services we provide. If you do not have the above ability and ability, it is recommended
that you read these Terms of Service accompanied by your guardian. You may not use the Services unless your
guardian agrees with your use of the Services and these Terms of Service. If you are liable under applicable
law or these Terms of Service, we will revoke our right of recourse to your guardian. The username,
nickname, icon, and other account info you fill in, log in, or use during the use of the service shall not
violate the provisions of laws and regulations, national systems, national interests, legitimate rights and
interests of citizens, public order, or social morality, and always provide true information. Any illegal or
harmful information is prohibited. You further guarantee that the account info you fill in, log in, or use
shall not contain the following: Violating the provisions of the Constitution and other laws and
regulations; Endangering national security, state secrets, state power and/or national unity; Damage to
national honor, interests or social public interests; Inciting ethnic hatred, ethnic discrimination, or
undermining ethnic unity; Violating state religious policies, propagating cults or superstitions; Spreading
rumors, disturbing social order or stability; Spreading, pornography, gambling, violence, murder, terror, or
abetting crime; Insulting or slandering others or harming the legitimate rights and interests of others;
Other aspects prohibited by laws and regulations. If the account information such as the account icon,
nickname, etc. you log in or use contains illegal or harmful information, we have the right to notify you to
correct or suspend the use of your account within a time limit or take other actions against you. If you log
in, use or fill in your username, nickname, icon as any entity or celebrity, we have the right to disable
the account and report it to the competent government department. You must keep your account and password
secure or you will be solely responsible for any damages caused by you, us, or any third party. You agree
that you will be solely responsible for all activities and events that occur under your account. You may
change the password for your account at any time. You agree to notify us immediately if you know or suspect
that your account is being used unlawfully or that there is an error.
For certain features of ShortMax
or individual services, such as posting content, posting comments and/or searching, you may need to provide
additional information in addition to creating your account, for example, you may need to display your
location or provide real-name authentication.
ShortMax is a social platform for connecting with others based on location. You can upload, browse, share,
search, and comment on videos on the platform. We hereby expressly remind you that you are responsible for
the legality, accuracy, completeness, truthfulness, or quality of your registration information and any
messages, files, text, software, music, audio, photos, images, videos, or information that you upload, post,
or store, transmit or post by any means through ShortMax.
You agree not to misuse the Services. You
warrant that you will use the Services within the bounds of laws and regulations and these Terms and will
not engage in any harmful, illegal, or infringing acts; otherwise, you shall bear full responsibility for
all consequences. Additionally, you shall fully indemnify us or any third party for any losses caused by the
above violations.
You agree to comply with the applicable laws and regulations and local ethical and cultural customs in your jurisdiction during the use of the service. Otherwise, you will be fully responsible for this. Moreover, please use the service appropriately and responsibly. If your actions cause us to violate laws and regulations or involve us in political or public events, we have the right to suspend or terminate the service.
In any event, you agree not to:
Use the Services for any illegal activity;
Use the Services for any activity that is or is likely to be
harmful to minors;
Send Email Spam, Junk Email, or assist others in sending Email Spam, Junk Email from
your account;
Display any inappropriate text, audio, or video (such as pornography, violence,
vulgarity, terror, barbarism, and other content that violates laws and regulations, social morality, or
national cultural traditions/customs);
Engage in any false or misleading activity (such as attempting
to solicit cash by fabricating false reasons or impersonating another person);
Perform any act that is
detrimental to the Services or others (e.g., post or distribute viruses, stalk, discriminate, post hate
speech/abusive comments, promote violence against others, or cruelty to animals);
Infringe the rights
of others (such as uploading, storing, or posting manuscripts, music, photos, or videos that are the
intellectual property of unauthorized third parties); Infringe on the privacy of others (such as secretly
photographing others);
Use the Services in any way that may interfere with, impair, affect, or limit
the proper use of the Services by other users, or in any way that may cause damage, disable or excessive use
of the Services or interfere with the proper functioning of the Services;
Send any unsolicited or
unauthorized advertising, solicitation messages, promotional materials, Email Spam, Junk Email, chain
letters, or pyramid schemes, or conceal or misrepresent the identity of the sender for the purpose of
sending Email Spam, Junk Email, or commercial email;
Obtain or collect email addresses, phone numbers,
IM numbers, and other information from other users without their consent;
Use any robot, spider,
crawler, scraper, or other automated means to access our services or collect data;
Reverse Engineer or
obtain the source code of the Service in any way, or circumvent or circumvent measures implemented to
prevent or restrict access to any area, content, or code of the Service; Use or attempt to use any
unauthorized account; Impersonate or post information on behalf of any other person or entity, or
misrepresent your affiliation with any other person or entity; Attempt to circumvent any content filtering
technology that we may use, or attempt to access any services or areas that you do not have access to; Place
any advertising to recommend products or services outside of ShortMax and its affiliates. You also agree not
to solicit our users to use similar competitive products or platform services for any reason or in any way;
Engage in any activity that violates any laws, regulations, policies, or rules of ShortMax or is detrimental
to us and/or other users. You acknowledge and agree that you will not use the Services for sale or any other
commercial purposes without our affirmative consent. If you wish to use the Services for commercial
purposes, please give us written notice and obtain official authorization. You agree to be responsible for
your actions during the use of the service, including but not limited to direct compensation to the
infringed party, and/or full compensation for our losses if your actions cause us to bear administrative
penalties or infringement damages. For any violation of the above provisions, we may immediately suspend or
terminate your access to some or all of the services at our sole discretion, including freezing or canceling
your access to your account and/or deleting your user content. You acknowledge and agree that we may, at the
request of the competent department, provide the necessary information you submit or store on the ShortMax
server during the use of the service to the competent department. After our preliminary assessment, if you
are suspected of infringing on the legitimate rights and interests of others, we may provide the
above-mentioned necessary information to the relevant right holder. You acknowledge that this service only
provides a platform for sharing videos. Any other devices (such as PCs, mobile phones, and devices connected
to the internet or network) and their costs (such as phone bills, internet connection fees, or mobile
network fees) related to this service will be borne by you. You acknowledge that we may publish commercial
advertisements and other commercial information in various ways in the course of providing the Services. You
agree that we may provide you with such information by sending emails, private messages, or otherwise.
Unless otherwise expressly provided in these Terms, all new products, features, and services introduced by
ShortMax shall be governed by these Terms.
Data
Unless otherwise proven, the data stored on the
ShortMax server will be considered as the only evidence to verify your use of the service.
All intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, and any other proprietary rights related to ShortMax, are owned by us or our licensors. Except as expressly provided in these Terms, no license or other rights to the intellectual property are granted to you. You agree not to infringe upon our intellectual property rights or those of our licensors. Any unauthorized use of our intellectual property rights is a violation of these Terms and may also violate applicable laws, including without limitation copyright and trademark laws and applicable communications regulations and statutes.
The Service and all content displayed on ShortMax (including but not limited to trademarks, logos, marks,
applications, source code, programming interfaces, web pages, text, images, audio, video, graphics, and when
you use the Service on our Platform) Ownership and intellectual property rights (including but not limited
to copyrights, trademarks, and patents) belong to ShortMax or other rights holders. Unless otherwise agreed,
you agree not to use, modify, copy, distribute, change, transmit, or publish the above content without our
written consent, otherwise you are responsible for indemnifying us or other rights holders for all losses
caused by it.
You acknowledge that you own all rights to upload and post relevant content (including
but not limited to text, images, audio, video, or performances, music, sounds or dialogue contained in
audio/video) on ShortMax. If the content you upload or post on ShortMax involves the interests or intellectual
property rights of any third party, you warrant that you have obtained the legal authorization of the
relevant right holder before uploading or posting the content. You also warrant that you will not enter into
any agreement that restricts your performance of the following obligations. Due to the nature of certain
features of ShortMax, you acknowledge and agree that other users of ShortMax may use the content you upload or
post on the platform when creating or posting content on ShortMax. Therefore, you agree that when using other
users' content for creation, you will respect the ownership and intellectual property rights of such legal
owners. You agree to abide by these Terms and the requirements of the legal owners when using such materials
and works. We do not guarantee that you can use the above materials and works in various ways. For example,
your use may be limited by authorship, privacy, trademark and/or portrait rights. We make no warranties,
implied or otherwise, as to the fitness, legality, non-infringement or fitness for a particular purpose of
the content (including scripts and materials, etc.) provided by us or other users.
You hereby grant us a worldwide, perpetual, non-exclusive, irrevocable, royalty-free, sublicensable right to use, modify, reproduce, distribute, publish, post, link, publicly perform, test, publicly transmit, distribute, advertise or otherwise use the content you upload or post (including but not limited to text, pictures, music, performances and audio and video recordings, etc.) and in our promotional materials (including but not limited to web pages, printed materials and commercial documents, etc.) use your real name, nickname, likeness, icon Or any other text or graphics of a similar nature. You also grant us the right, individually and independently, to sue or take other legal action for any infringement of intellectual property rights in the content you upload or post, and to receive all compensation, if any.
If you believe that any content uploaded by the Platform infringes your legitimate rights and interests, please send us a notice in accordance with the applicable rules of the Platform. If we receive a notice of alleged infringement regarding content uploaded by you, in order to protect the intellectual property rights of the legitimate owner, we may remove the allegedly infringing content at our discretion and notify you as soon as possible so that you can work out a solution together with the legitimate owner. You may send us a counter-notice; but this will not affect the measures we will take/have taken on our own.
We are committed to respecting the privacy of our users and may collect, store, use, disclose and protect your personal information in accordance with our Privacy Policy. The detailed policy can be found in the Privacy Policy, and we encourage you to read it carefully.
Force Majeure: We do not assume any responsibility for any damage or loss caused by force majeure. For the purposes of this Agreement, force majeure includes force majeure, changes in laws and regulations or government orders, specific causes due to the characteristics of internet services, such as failures attributable to domestic and/or foreign basic telecommunications operators, computer or Internet-related technical defects, Internet coverage restrictions, computer viruses, hacker attacks, and other unforeseen, unavoidable and insurmountable situations to the extent permitted by laws and regulations.
ShortMax is a platform for connecting people and will not directly upload or provide content. The content or
information posted by users does not represent our views, positions, or policies. We make no warranty as to
the accuracy, reliability, completeness, legality, and validity of the content or information you come into
contact with during your use of the service. You acknowledge that you may come into contact with unpleasant
content while using the service. You agree to judge the content for yourself, and we will not be liable for
any damages you suffer as a result of your reliance on such content. You agree to negotiate and resolve any
disputes and/or losses between you and other users or between you and other rights holders that arise or may
arise from the use of the relevant content or works, and you will not be liable for such disputes or losses
in any event.
Please pay attention to the surrounding environment during the use of the service to
ensure your personal safety. You agree that under no circumstances will we be liable for any personal injury
or property damage caused by you (to you or any third party) during your use of the service.
Change,
Suspension, Interruption, and Termination of Service: We reserve the right to change, suspend, interrupt or
terminate the Service for the following purposes: to carry out our business decisions; to carry out
administrative/judicial orders; to protect the security of the Service; to maintain the correct use of the
Service by other users and the security of data; to respond to alleged infringement by others; or in our own
judgment, we suspect that your actions violate the Terms of Service or rules issued from time to time, or
violate laws and regulations. In such cases, we reserve the right to change, suspend, interrupt or terminate
the services provided to you and to remove all your content immediately without any liability to you or any
third party.
Notices: All notices to you under this Agreement may be sent by email, regular mail, or via prominent postings on the Site/Platform.
These Terms are governed by the corresponding national laws of each country, without considering the principle of conflict of laws. In the event of any conflict between these Terms and the laws of each country, the provisions of the national law shall prevail. In such a case, the relevant content shall be modified or reinterpreted in accordance with the provisions of the law, and the validity of the rest of these Terms shall remain unchanged. Any dispute arising out of or in connection with these Terms shall be submitted to the International Economic and Trade Arbitration Commission ("IETAC") for arbitration in accordance with its rules in force at the time. The language of arbitration shall be English, and the arbitral tribunal shall consist of three arbitrators. The arbitral award shall be final and binding on the parties.
These terms are effective as of the date of posting and constitute the entire agreement between you and ShortMax.
Our failure to exercise, delay in exercising, and partial exercise of our rights under the law and the Terms shall not be deemed a waiver of such rights nor shall it prejudice our future exercise of such rights.
